Policy No. 6450 Use of Privately-Owned Property

Use of Privately-Owned Property

Individual schools or the district at large, are authorized by the Board of Education to accept the loan and use of privately owned property which may enrich educational offerings to pupils, providing an agreement on a form provided by the Board is executed and entered into by the Owner and the Principal, or district officer as agent of the Board of Education. The following stipulations are to be embodied in the agreement:

  1. That neither the school nor the Board of Education nor its employees shall assume any obligations of liability for any damage to the property by loss as a result of fire, theft, or storm.
  2. That neither the school, the Board of Education, nor its employees shall be held responsible for the repair, maintenance or upkeep of such privately owned property, except that with the consent of the owner, the Board, in its discretion, may make such repairs, maintenance or upkeep if, in its judgment, the continued utility of the item justifies the expense.
  3. That school personnel will exercise reasonable precaution in the care and maintenance of the loaned item, attempting to preserve it in good condition, equal of its condition upon arrival at the school, except for reasonable wear and tear.
  4. That upon ten days notice, the Owner will provide space and means for removal of such loaned items, that no longer contribute to the welfare of the school, or if such has fulfilled its usefulness or has been declared a problem or a nuisance.
  5. That the school shall upon acceptance of any such loaned item, provide adequate space for housing the same.
  6. That the school shall at all times, reserve the right to accept or reject any proposed loan of privately owned property items.
  7. That the opportunities provided due to the loan, shall be expressed in terms of appreciation by attempting to care for such property as the Owner himself reasonably would provide at his own home.
  8. That any such loaned items shall be released from the school to the Owner within ten days of the request of the Owner.
  9. That no rental shall be paid for the use of the said property.
