Classified Procedural Agreement Personnel

  1. The Board of Education and the Cache Classified Employees Association agree that items negotiated between the Board of Education and the Association will be the policy of the Board for the year negotiated. The Board and the Association further agree that either party may at any time during the year request in writing that any negotiated policy in effect be renegotiated. Upon such request, the parties will meet and determine if the policy identified should be changed or eliminated. It is understood that the personnel policies shall remain in effect for the year negotiated until both parties agree regarding action to be taken to modify or delete a policy. The Cache Classified Employees Association is recognized as the exclusive representative of all classified personnel of the Cache County School District, excluding District administrators.
  2. Exception to the procedure shall occur when the District experiences a loss of revenue, or the reduction or discontinuance of a program. In such circumstances, the Board may take independent action, but will confer with the Association regarding alternatives prior to taking official actions. Classified employee contracts will be honored unless re-negotiated.
  3. If any provision of this contract is held by a court of law to be contrary to law, then such provision will be deemed invalid to the extent required by such court. All other provisions of this contract will continue in full force and effect. Whenever a provision is deemed invalid, both parties will meet within 10 days of the court ruling to renegotiate the provisions affected.
